Terms of Service Conditions
for the delivering of temporary accommodation services
Please read the text of this Terms of Service Conditions and if you do not agree with any of the clauses of this Terms of Service Conditions or if you do not understand any of the clauses of this Terms of Service Conditions, we suggest seeking additional explanations at the Hotel staff.
Services are provided at the hotel “Fazenda na Goncharakh”, located at Pustomitivskiy district, Lviv region, Gonchari village, 200 (hereinafter referred to as “the Hotel”), and include the accommodation of individuals by providing temporary accommodation.
If you accept the Services offered at the Hotel, you are deemed to fully and unconditionally agree to all of the terms and conditions of the following Terms of Service Conditions on the provision of services and rules of hotel accommodation, fully and unconditionally accept them (including agreeing to abide by all obligations imposed on you by a Terms of Service Conditions for the provision of services and rules for hotel accommodation) and you understand all their positions. The Terms of Service Conditions for the provision of services and the rules of stay at the Hotel determine the content of the rights, obligations, and responsibilities of the Hotel and the User, act simultaneously and complement each other.
This Terms of Service Conditions define the terms of the contract in accordance with Article 641 of the Civil Code of Ukraine and is an official public offer addressed to other persons (hereinafter referred to as “User” or “Users” or “Client” or “Consumer” or “Consumers” or “Guest” or “Guests”), conclude into an agreement to provide the User with accommodation services (providing temporary accommodation) with the following condition.
Hereinafter referred to as the Terms of Service Conditions, the Hotel and the User are collectively referred to as the “Parties” and each separately as the “Party”.
1.3. Each Party guarantees to the other Party that it has the necessary capacity, as well as all the rights and powers necessary and sufficient to conclude and execute the Agreement in accordance with its terms.

1.5. The User agrees to the communication to third parties of information arising out from the execution of this Terms of Service Conditions and the receipt by the User of services from the Hotel.
2. Offer (Terms of service conditions) / Subject of the contract
2.1. The subject of the Terms of Service Conditions is the provision of paid accommodation services of the Hotel to the User, by providing a room (place) for temporary residence at the address of the Hotel, in a specially equipped accommodation place (room) in accordance with the booking order.
2.2. The contract became concluded and enters into its straight of the contract of accession from the moment of implementation by the Client of any action provided by clause 3.4 of the contract, which means full and unconditional acceptance by the latter of all terms of the contract without any exceptions and/or restrictions in accordance with Article 642 of the Civil Code of Ukraine. The contract for the provision of placement services concluded by the User with the acceptance of the Terms of Service Conditions, has legal effect in accordance with Article 642 of the Civil Code of Ukraine and is tantamount to the agreement signed by the parties and considered such that the User has read and agrees to the terms of this Terms of Service Conditions.
3. The order of conclusion of the contract
3.1. The agreement is concluded between the Hotel and the User in the form of an agreement of accession (Article 634 of the Civil Code of Ukraine).
3.2. Acceptance of a Terms of Service Conditions is the performance by the User of any of the actions specified in clause 3.4 of the Agreement.
3.3. Acceptance of the Terms of Service Conditions means full and unconditional acceptance by the User of all terms of the contract without any exceptions and/or restrictions and is equated in accordance with Part 2 of Article 642 of the Civil Code of Ukraine to the conclusion by the Parties of a bilateral written agreement on the terms set out in this Terms of Service Conditions.
The conclusion of the agreement means that the User:
fully acquainted with and agree with the rules of stay at the Hotel;
acknowledges the unconditional suitability of the premises of the Hotel to meet the needs described in this Agreement;
accepts all the terms of this agreement without any objection or restriction.
3.4. In accordance with Article 642 of the Civil Code of Ukraine, the User confirms the fact of acceptance of the Terms of Service Conditions in the case of performing any of the following actions:
payment for temporary accommodation services through the reception and accommodation service or by bank transfer based on invoices, or by bank card;
direct use of the Hotel services by the User (settlement);
filling in the registration form/receipt/questionnaire at the reception.
3.5. The user is obliged to enter (notify) independently when registering to receive the services of the Hotel authentic personal data and information that is true.
3.6. The acceptance of this Terms of Service Conditions is unlimited.
4. Calculation procedure
4.1. Services of the Hotel, including additional services, are provided to the User on a paid basis in accordance with the terms of the contract and the tariffs/prices indicated on the information stands, in the consumer’s corner, menus, price lists, other information documentation of the Hotel and/or on the Hotel website, subject to selected room category. The rates/prices for the Hotel’s services and their list are determined and modified solely by the sole decision of the Hotel.
4.2. The right to receive/use the Services of the Hotel is usually granted after payment for the relevant Services, in accordance with the Rates/Prices. The Hotel has the right to provide the User services without prepayment.
4.3. The Hotel has the right to apply free rates and discounts on temporary accommodation services.
4.4. Payment for services in the Hotel is made in cash, bank cards Visa, Mastercard or cashless bank transfer.
4.5. After the paid period of stay ended the User is obliged to leave the room and release it from personal belongings and luggage no later than 12:00 hours by Kyiv time (check-out time) of the last paid day of stay or to pay the extension of the period of stay in the room in the absence of booking of the specified number by third parties.
4.6. Check-in time at the Hotel starts at 14:00 by Kyiv time.
4.7. Early check-in and late check-out are an additional services, which is charged for the selected room category according to the prices indicated on the information stand, in the consumer’s corner, prices, other information documentation of the Hotel and/or on the Hotel’s website.
4.8. In the case of rendering the Services without prepayment by the Hotel, the User is obliged to pay for such services on the day of the end of the period of stay according to the invoice and according to the prices indicated on the stands, prices, prices, other information documentation of the Hotel and/or on the website Hotel.
In this case, the User pays for the provided services (fulfills the terms of the Agreement) at the location of the Hotel (“Fazenda na Goncharakh”, located at Pustomitivskiy district, Lviv region, Gonchari village, 200).
5. The procedure for registration of hotel accommodation. Procedure for early termination of delivering of User-initiated placement services
5.1. The accommodation of the User in the Hotel is made on a preliminary paid basis, that is, when making 100% payment for temporary accommodation services at the agreed-upon reception period according to the prices indicated on the stands, prices, prices, other information documentation of the Hotel and/or on the Hotel’s website, with simultaneous presentation by the User of the reception of documents proving his/her identity (passport of a citizen of Ukraine, including for traveling abroad, birth certificate – for persons under 16 years of age without their parents, guardians, etc., passport of a foreign state or a stateless person, migration card) and the filling and leaving at the reception for user-defined form. In the absence of the above documents, the User recognizes the right of the receptionist to refuse to provide temporary accommodation services at the Hotel.
5.2. In case the User refuses the booked service or changes the start and/or end date of the service for any reason, which is not dependent on the Hotel, changing the terms of service at the User’s initiative after its payment is equal to the refusal (partial refusal) of the service, and in favor of the Hotel by 100% of the cost of the service per day is charged.
6. Force majeure
6.1. In case of force majeure circumstances: war, flood, earthquakes, fires, strikes, epidemics, changes in legislation, etc., the parties are partially or fully exempted from the obligations under this agreement.
6.2. A Party which has been unable to fulfill its obligations as a result of force majeure shall be obliged to notify the other Party in writing of the occurrence and termination of such circumstances.
6.3. The action of force majeure must be confirmed by the appropriate competent authority.
7. Accommodation of children
7.1. Accommodation of one child up to 3 years in the room, in excess of the established number of residents for the corresponding room category, no fee for accommodation services will be charged.
7.2. The conditions of admission and placement of groups of children accompanied by adults are regulated on a case-by-case basis.
8. Additional services of the Hotel
8.1. In addition to the accommodation services, the hotel provides the following services at no charge:
storage of luggage;
use of iron and ironing board;
wireless Internet access;
access to TV channels.
8.2. Other additional services are provided at the rates/prices indicated on the information stands, in the consumer’s corner, menus, price lists, prices, other information of the Hotel and/or on the Hotel’s website, taking into account the selected room category.
9. Rights and Responsibilities of Users of Accommodation Services at the Hotel
9.1. Users of accommodation services have the right:
use the accommodation and additional services in the manner specified in this Terms of Service Conditions and in the rules of stay at the Hotel, other documents of the Hotel;
to receive complete and reliable information about the hours of access to the Hotel territory, the cost of services provided within the Hotel territory;
to contact the reception staff on the quality of temporary accommodation service, to leave complaints, feedback, and suggestions in the book of complaints and suggestions, which is located in the corner of the consumer.
9.2. Users of accommodation services must:
unconditionally observe the terms and conditions of this Terms of Service Conditions;
respect the rights of other guests of the Hotel;
abide by moral and ethical standards, abstain from using obscene statements in the public areas of the Hotel;
adhere to the rules of residence at the Hotel, the rules of use of the infrastructure of the Hotel, the rules of access to them, which can be found at the reception;
to protect the property of the Hotel. In case of loss or damage of the property due to fault of the User (including towels, bedding, dishes, furniture, various equipment, etc.), which are on the territory of the hotel, the guest is obliged to within 3 calendar days, but not later than the date of check-out from the hotel to compensate for the damage, the amount of which is determined: according to the prices indicated on the information stands, in the corner of the consumer, menus, price lists, prices, other information documentation of the Hotel and/or on the Hotel website, and in the absence of such prices by a committee consisting of administrator, receptionist and any other employee of the Hotel on terms of transparency and at the market value of lost or damaged property;
comply with the rules of fire safety and rational use of the hotel’s electrical appliances and equipment.
10. Rights and Obligations of the Hotel
10.1. The Hotel is obliged to:
to provide paid services to the User in a timely, high quality and in full;
inform the User about the services provided within the Hotel and the form and procedure for their payment;
to ensure full compliance of the services provided to the sanitary and epidemiological norms and rules;
respond promptly to Users requests for the provision of temporary accommodation services by taking steps to eliminate failures in the hotel rooms as soon as possible (in the event of failure to remedy an accident or breakdown in the room, Hotel should provide a different room of category which is no lower than that agreed at the check-in date;
to be responsible for the completeness and serviceability of the equipment in the rooms, as well as for the quality of preparation of the room for occupancy;
The Hotel is not responsible for money, belongings and any other tangible items left in the room, lost in the Hotel, or lost for any reason.
10.2. The Hotel can:
come into the Hotel room for cleaning, linen change, checking of water supply systems, air conditioning or elimination of defects in their functioning, as well as in case of violation of the provisions of this Terms of Service Conditions by the User;
in case of expiration of 100% paid period of stay of the User in the Hotel and/or absence of the User at the place of temporary residence for more than 2 hours without payment, independently vacate the room from the personal belongings of the User, making a description of the property left by the User;
in case of violation by the User of the accepted norms of behavior invite employees of law-enforcement officers for establishing the facts of such violations;
prematurely, without refund to the User payment for temporary accommodation, to terminate the contract for the provision of temporary accommodation services, with simultaneously forced eviction from the territory of the Hotel in the case of:
being in a condition of heavy alcohol and/or drug and/or toxic intoxication or under the influence of other psychotropic substances;
smoking in the rooms, as well as on the territory of the Hotel, except for specially designated places;
without the approval of the reception and without the proper permits for the storage or bringing of weapons, explosive and flammable, caustic, poisonous, narcotic substances and other dangerous objects;
violation rules of public order;
violation of the rules of stay at the Hotel;
violation of the Terms of Service Conditions;
systematic complaints of other guests of the Hotel about the violation of their rights and freedoms.
11. At the Hotel prohibited:
to invite to the rooms of third parties;
transfer the key-card to the third parties;
to store in the room overall things and objects, except suitcases, (boxes larger than 100 x 100 x 100 cm, bicycles, scooters, mopeds, etc.);
move furniture and move interior items;
smoke in the rooms and other non-smoking places;
disturb other guests of the hotel after 22:00 hour, creating a noise;
store or bring weapons, explosive and flammable, caustic, poisonous, poisonous, narcotics and other dangerous items. Users who have the right to carry and hold arms are obliged to notify the reception on the day of arrival by providing the relevant permits;
remove dishes and cutlery from rooms and outside catering establishments;
takeout food and drink outside the food establishments;
to eat in the room food and drinks (except those placed at the Hotel minibar);
deliberately pollute the area of the Hotel with cigarette butts, garbage, etc.;
to throw any objects and things from balconies or windows;
use your own irons, electric heaters, boilers, kettles, etc. not included in the room;
In case of violation of the Guest’s rules of conduct and/or duties, specified in sections 9-11 of this Terms of Service Conditions, the reception may refuse the guest to continue providing temporary accommodation services and therefore stay at the Hotel, with the obligatory drafting of the relevant document and, if necessary, with the involvement of law enforcement officers.
Users acknowledge the right of the Hotel not to provide temporary accommodation to persons who:
according to the reception desk, are in a state of strong alcohol and/or drug and/or toxic intoxication or under the influence of psychotropic substances;
store or bring weapons, explosive and flammable, caustic, poisonous, narcotic and other dangerous objects and substances without the approval of the reception desk and without proper permits;
did not provide identification documents;
intend to occupy more persons in the room than the corresponding category of the room provides.
12.1. In case of complaints, the User must submit a complaint, a check (receipt, etc.) to the Hotel, a document of stating at the Hotel that confirming violation of the Terms of Service Conditions, documents confirming the actual losses. Complaints and all necessary documents shall be provided to the Hotel no later than 14 days after the end of the service. All complaints are considered by the Hotel only if the Hotel has been informed about the violation of the terms of service in advance in order to eliminate them within the next 12 hours.
12.2. The property reviews the claim within 20 days.
12.3. Complaints made with violation of the requirements of the Terms of Service Conditions are not considered.
